Agreement to these terms
We are Advanced Nonlinear Technologies Ltd, doing business as Antelligent and ANT (“Company”, “we”, “us”, or “our”). We operate the website fernfly.com(the “Site”) and any related products and services that link to these terms (collectively, the “Services”). These Terms of Service form a legally binding agreement between you (whether personally or on behalf of an organisation) and Advanced Nonlinear Technologies Ltd regarding your use of the Services. By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must not use the Services.
We may update these terms from time to time. Changes take effect once we post the revised terms and update the “Last updated” date, and your continued use of the Services means you accept them. The Services are intended for users who are at least 18 years old; anyone under 18 may not use or register for them.
1. Our services
The Services are not directed at anyone in a jurisdiction where their use would be unlawful. If you access the Services from elsewhere, you do so on your own initiative and are responsible for complying with local law. The Services are not designed to meet industry-specific regulations such as HIPAA, FISMA, or the GLBA, so you may not use them where such laws would apply to your activity.
2. Intellectual property
We own or license all intellectual property in the Services, including the source code, databases, software, designs, text, graphics, and media (the “Content”), as well as our trademarks and logos (the “Marks”). These are protected by applicable intellectual property laws. Subject to these terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print portions of the Content for your personal, non-commercial use or internal business purposes.
Except as expressly permitted, no part of the Services or Content may be copied, reproduced, republished, distributed, sold, or otherwise exploited for commercial purposes without our prior written permission. To request such permission, reach us through our contact form. We reserve all rights not expressly granted.
Your submissions. Any feedback, suggestions, or ideas you send us about the Services may be used by us without restriction or compensation. If the Services let you post content (“Contributions”), you remain responsible for it, you confirm you have the rights to share it, and you agree it will not be unlawful, infringing, or otherwise objectionable. We may remove or edit Contributions at our discretion.
3. Your representations
By using the Services, you represent and warrant that the registration information you provide is true and current and that you will keep it accurate; that you have the legal capacity to agree to these terms; that you are not a minor; that you will not access the Services through automated or non-human means; and that you will not use the Services for any unlawful or unauthorised purpose. If you provide information that is untrue or incomplete, we may suspend or terminate your account.
4. Website scanning
Parts of the Services build a model from a website you nominate. When you give us a web address, we fetch its publicly reachable pages and analyse them to work out what the site offers. We only read pages that are open to any visitor: we do not sign in, we do not attempt to bypass a login, paywall, or other access control, and we do not reach anything a member of the public could not.
Your warranty. By submitting a web address you represent and warrant that you own the site, or that you are otherwise authorised by its owner to have it scanned by us for this purpose, and that doing so breaches no law, contract, licence, or the site's own terms of use. You are solely responsible for confirming you hold those rights before you submit an address. Do not submit a site you do not own or have permission to scan.
We do not verify ownership or permission, and we rely on your warranty. You agree to indemnify us in accordance with the Indemnification section below against any claim arising from a site you nominated without the necessary rights. We may refuse, stop, or undo a scan at any time and for any reason, and we may honour a request from a site owner to stop scanning their site.
Content we retrieve is processed to create your model and to provide the Services to you. We do not publish the retrieved pages, and our handling of them is covered by the Privacy and Your data sections below. A site you nominate remains subject to its own owner's rights: nothing here transfers any ownership of it to you or to us.
5. Account registration
You may need to register to use the Services. You are responsible for keeping your password confidential and for all activity under your account. We may remove or reclaim a username that we consider inappropriate or objectionable.
6. Purchases and payment
We accept Visa, Mastercard, American Express, and Discover. You agree to provide current, complete, and accurate purchase and account information and to keep it up to date. Prices are in US dollars, and applicable sales tax may be added. We may change prices, correct pricing errors, and refuse or limit any order at our discretion, including orders that appear to be placed by resellers.
7. Prohibited activities
You may use the Services only for their intended purpose. You agree not to, among other things:
- systematically retrieve data to build a collection or database without our written permission;
- trick, defraud, or mislead us or other users, or attempt to obtain other users’ account information;
- circumvent, disable, or interfere with security-related features of the Services;
- use the Services to harass, abuse, or harm another person, or to misuse our support services;
- upload viruses or other malicious code, or otherwise disrupt the Services;
- use bots, scrapers, or other automated tools to access the Services or collect data;
- impersonate another user, or remove any copyright or proprietary notices;
- copy, reverse engineer, decompile, or disassemble any of the software behind the Services, except as permitted by law;
- collect usernames or email addresses to send unsolicited messages; or
- use the Services to compete with us or for any unauthorised commercial purpose.
8. User contributions and licence
If you post Contributions, you represent that they are yours to share and do not infringe anyone else’s rights or violate any law. You retain ownership of your Contributions, but you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to host, use, copy, reproduce, publish, distribute, and create derivative works from them in connection with operating and promoting the Services. We have no obligation to monitor Contributions but may edit, re-categorise, or remove them at our discretion.
9. Reviews
Where the Services allow reviews or ratings, your reviews must reflect genuine firsthand experience, must not contain offensive, discriminatory, or false content, and must not be posted as part of an organised campaign. We may accept, reject, or remove reviews at our discretion, and reviews do not represent our views.
10. Managing the Services
We reserve the right, but are not obligated, to monitor the Services for violations of these terms, to take legal action against violators, to restrict or disable Contributions, to remove content that burdens our systems, and to otherwise manage the Services to protect our rights and ensure they function properly.
11. Privacy
We care about data privacy and security. Your use of the Services is also governed by our Privacy Policy, which is incorporated into these terms. Please be aware that, where the Services are hosted, your data may be transferred to and processed in a country with data protection laws that differ from those where you live, and by continuing to use the Services you consent to that transfer.
12. Term and termination
These terms remain in effect while you use the Services. We may, at our sole discretion and without notice or liability, deny access to the Services to anyone for any reason, including for breach of these terms or applicable law, and we may suspend or delete your account and any content you posted. If your account is terminated, you may not register a new one under your name or any other name.
13. Modifications and interruptions
We may change, modify, or remove the contents of the Services at any time and without notice, and we are not obligated to update any information. We cannot guarantee the Services will always be available — they may be interrupted by maintenance or technical issues — and we are not liable for any loss or inconvenience caused by downtime or discontinuation.
14. Governing law
These terms are governed by and interpreted in accordance with the laws of the United Kingdom, and the UN Convention on Contracts for the International Sale of Goods does not apply. We and you both agree to submit to the non-exclusive jurisdiction of the courts of London. If you are a consumer in the EU, you also keep the protection of the mandatory laws of your country of residence.
15. Disclaimer
The Services are provided on an “as is” and “as available” basis, and you use them at your own risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty about the accuracy or completeness of the Services’ content or any linked third-party sites, and we are not responsible for transactions between you and any third-party provider.
16. Limitation of liability
To the fullest extent permitted by law, in no event will we or our directors, employees, or agents be liable to you for any indirect, consequential, exemplary, incidental, special, or punitive damages — including lost profits, lost revenue, or loss of data — arising from your use of the Services. Our total liability to you, regardless of the form of action, will at all times be limited to the amount you paid us, if any, during the six (6) months before the cause of action arose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold us and our affiliates and personnel harmless from any loss, damage, liability, claim, or demand (including reasonable legal fees) arising from your Contributions, your use of the Services, your breach of these terms, or your violation of a third party’s rights. We may assume the exclusive defence of any such matter at your expense, and you agree to cooperate.
18. Your data
We maintain certain data you transmit in order to manage the Services and your use of them. Although we perform routine backups, you are solely responsible for the data you transmit or that relates to your activity. You agree that we are not liable for any loss or corruption of such data and waive any claim against us arising from it.
19. Electronic communications
Visiting the Services, emailing us, and completing online forms count as electronic communications. You consent to receive communications electronically and agree that electronic agreements, notices, and records satisfy any legal requirement that they be in writing. You also consent to the use of electronic signatures and records.
20. California users

21. Miscellaneous
These terms, together with any policies we post, constitute the entire agreement between you and us. Our failure to enforce any provision is not a waiver of it. If any provision is found unlawful or unenforceable, it is severed without affecting the remaining provisions. These terms create no joint venture, partnership, employment, or agency relationship between us, and they will not be construed against us for having drafted them.
